SD Trading UK (Ipswich) Ltd Terms and Conditions

The following is a legally binding contract between you and SD Trading UK (Ipswich) Ltd. You agree to the terms of this Agreement, and you re-affirm that agreement every time you buy or bid or make other use of any of our trade services.


1.1 No warranties/As is
The description(s) of the vehicle/vehicle damage are general indications only and are unlikely to be a complete list and shouldn’t be held as accurate descriptions.

Unless specifically stated otherwise, we offer the vehicles in their current state and location with no guarantee whatsoever as to condition, roadworthiness, or recorded mileage.

The vehicles are offered in a damaged or incomplete condition having been the subject of an insurance company total loss and we expressly exclude any warranty as to the suitability, merchantability, or fitness for any purpose of any vehicle purchased.

The Vehicles offered in a road worth state (normally have been taken as part exchanges or stolen recovered) will all be 'sold as seen'. It is the buyers responsibility to view, test drive and complete any pre-inspection checks before the completed sale. Once the sale is completed, it will be deemed an acceptance of the terms and conditions.  

It is the responsibility of the buyer to ensure that the vehicle is in a roadworthy condition before the vehicle is used or re-sold.

We strongly advise you to inspect the vehicle before making a bid/offer.

 

All sales are deemed trade sales therefore the consumer act 2015 does not apply.

2.1 Vehicle Documents

We do not supply existing Vehicle Registration Documents (V5s) or MOT certificates with the vehicles unless we specifically state in the Vehicle Details that they will be provided.

However, we will normally notify Swansea of the change of ownership to the Purchaser. The name and address notified will be the full name and address on your invoice

No mileage guarantee, It is up to the buyer to deem that the mileage is correct prior to purchase. Mot data can be found online plus it can be checked against the mileage database. 


3.1 Cherished Plates

The buyer of a vehicle does not get Title to the Registration Number which will remain our property unless otherwise stated. If required by us, the Purchaser will take all steps to make the Plate available to us without cost to ourselves.

4.1 Signwriting on Vehicles

We reserve the right to remove or obscure any signwriting that may be on an vehicle before or after the sale.

5.1 Vehicle Keys

It will be clearly stated if key/s are or are not available in our adverts unless otherwise stated. More than one key will only be issued if stated on the advert. It is the responsibility of the buyer to ensure that the key/s is available and we will not be accounted for if the key/s are lost or stolen after the transaction stage. 

6.1 Check The Category Of The Vehicle

Salvage vehicles in categories B, C, D, S and N are categorised as per the Association of British Insurers Code of Practice for the Disposal of Motor Vehicle Salvage. It is the buyers responsbility to Hpi all vehicles before purchase to confirm the category. All vehicles will be hpi checked to assure no outstanding finance is owed on the vehicle. All data supplied is from Hpi at the time of purchase and will be available to the buyer. Categories X and U have been introduced by to assist the buyer when purchasing vehicles outside of this.

Categories are as follows:

  • Category B: Heavy damage, chassis bent. Not repairable, to be broken for parts and sold to specially registered buyers only

  • Category C: Repairable vehicles where the insurer's repair costs exceeded the vehicle's pre accident value

  • Category D: Repairable vehicles where the insurer's repair costs did not exceed the vehicle's pre accident value

  • Category X: Stolen and recovered vehicles with minimal or no damage.

  • Category S: Vehicle has sustained structural but repairable damage

  • Category N: Vehicle has sustained NO structural damage and its repairable

  • Category U: Vehicles not owned by an insurance company that may have sustained damage / dealer part exchange.



7.1 Buyer Requirement

You must be over 18 years old and able to form legally binding contracts.

8.1 Vat

You agree (and will sign a declaration if requested) that input tax deduction has not been and will not be claimed by you in respect of non-Vattable vehicles bought from SD Trading UK (Ipswich) Ltd.

9.1 Payment currency

All payments to us must be in pounds sterling.

10.1 Collection / hours

You are responsible for collecting the vehicle from our site or arranging delivery of the vehicle with ourselves.

We can arrange collection times within reasonable hours as long as prior arrangements have been made.

Please contact us by phone or email at least 24hours before you wish to collect so we can make your vehicle available to you within a reasonable +/- of your requested date/ time.

If you don’t collect within 14 calendar days, then storage at £10.00 per day will be payable by you from day 15 to day 29 inclusive and if the vehicle has still not been collected then we retain the right to resale the vehicle with no refund to the current customer. Payment of any such storage charges must be made before the vehicle will be released.

10.2 COLLECTION/DELIVERY

At the yard you MUST check the salvage to ensure that you are satisfied with its condition before you remove it from the premises.

Removal of the Vehicle/Salvage Vehicle from the yard is your statement that you are happy with your purchase.

This applies whether you collect the vehicle/salvage vehicle personally or appoint a third party to collect on your behalf.

No refunds or compensation will be discussed after this time.

10.2.1 The dealer should upon delivery or collection check the Vehicle/Salvage Vehicle as this is deemed to be the point at which the dealer has accepted the vehicle/Salvage Vehicle. Refunds and compensation will not be given under any circumstances on a Vehicle/Salvage Vehicle after a dealer/customer has accepted it. In any scenario such rejection can only take place within 14 calendar days of the date of the Sale ("Payment and Collection Period")

10.2.2 The Buyer or their agent must provide either a current passport or photographic driving license as proof of identification when collecting the vehicle/Salvaged Vehicle. Failure to comply with this requirement may lead to the Contractor denying the Buyer or their agent access to the Salvaged Vehicle. For the avoidance of doubt, if a Buyer or their agent fails to provide the required identification and as a result the Salvaged Vehicle is not made available for collection, then no compensation will be made for the journey or storage costs accrued.


11.1 Payment

Deposits - All Deposits are Non-refundable and are required if we request it. The remaining balance from a deposit must be paid in full within 14 calendar days by bacs, cash or other guaranteed payment method. The vehicle will not be released until full payment has been received. If full payment is not completed in 14 calendar days then we reserve the right to cancel our contract with no compensation to you.

Full Payment – We can accept full single payments for vehicles. Once the funds are cleared into our account then the vehicle will be released. There is a limit on cash payments of £9,000 applicable to any single payment or series of payments relating to one or more purchases made by a buyer on the same day.


12.1 Non-payment

If you fail to pay in accordance with the contractual terms above, we reserve the right To re-sell the vehicle or to cancel our contract (without any compensation to you).



13.1 Indemnity to SD Trading UK

You agree to indemnify and hold SD Trading UK(Ipswich) ltd harmless from and against any third party claims, demands, action or causes of action arising out of or in connection with your use, resale or disposal of a Salvaged Vehicle.



14.1 Consequential loss

We will not be liable to you or any third party for an indirect or consequential loss or damage, or for any loss of data, profit, revenue or business, howsoever caused (whether arising out of any negligence or breach of this Agreement or otherwise), even if that loss or damage was foreseeable by us, or the possibility of it was brought to our attention.

15.1 Changes to this Agreement

We reserve the right to amend this Agreement from time to time.


16.1 Notices

This Agreement is governed by English Law.

17.1 Entire Agreement

This Agreement constitutes the entire agreement and understanding between you and us relating to the subject matter of this Agreement, and (in relation to that subject matter) supersedes any and all previous agreements, arrangements, statements and understandings, although nothing in this clause shall operate to limit or exclude liability for any fraud or fraudulent representation by either party. You and we each acknowledge and agree that, in entering into this Agreement and the documents referred to in it, neither of us rely on, and shall have no remedy in respect of, any statement, representation, warranty or understanding (whether negligently or innocently made) of any person (whether party to this Agreement or not).

18.1 General

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section.

Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.
